Crowder Rentals LLC — Rental Agreement
Version effective November 4, 2026
This Rental Agreement is between Crowder Rentals LLC, a Colorado limited liability company doing business as A&J Time Rentals, 11401 W 44th Ave #1, Wheat Ridge, CO 80033 (“Crowder Rentals,” “we,” “us”), and the renter named on the order (“you”). If you rent for a company, “you” also means that company, and you confirm that you are authorized to bind it.
It covers the equipment, items, dates, rates and charges shown on your order, whether you place the order on crowderrentals.com, by phone, or at our counter. Please read it. It includes your authorization for us to charge your card on file (Section 4), limits on our liability (Section 11), and a waiver of jury trial (Section 15).
1. What makes up this agreement
1.1 This agreement, your order, and the Rental Policy, Damage Waiver & Card on File and Delivery & Pickup pages as they read on the date of your order are the whole agreement for your rental.
1.2 If they conflict, your order controls the equipment, quantities, dates and rates; this agreement controls everything else. Our Terms of Service govern your use of our website; for a rental, this agreement controls.
1.3 The current version of this agreement is always at crowderrentals.com/rental-agreement/. We email a copy with your order confirmation and print one on request.
2. Who may rent and operate the equipment
2.1 You must be at least 18 and show a valid government-issued photo ID. Delivery orders need, at checkout, a valid driver’s license for the person who will receive the equipment; pickup orders show ID at the counter.
2.2 Rentals are normally paid with a credit or debit card in your name, or billed to an approved business account. We may accept cash or a check for a rental at our discretion.
2.3 Only you, or competent adults you authorize (such as your employees), may operate the equipment. You are responsible for everyone who uses it and for their training. Operators of powered equipment must have experience with that class of machine. Our walkthrough at pickup or delivery is a courtesy, not operator training.
2.4 We may refuse or end a rental if we believe the equipment cannot be used safely, if identification or payment cannot be verified, or if an account is past due.
3. Rental period and charges
3.1 When it starts and ends. The rental starts at the reserved start time, or when the equipment leaves our control if earlier, and ends when we check the equipment in at our yard or our driver collects it.
3.2 Time out, not time used. Rental charges are for time out, including hours we are closed, weather delays and idle time. A day is 24 hours from the start time.
3.3 Rates. Rates are for 4 hours, a day, a week and a 4-week period. There are no hourly rates. The shortest rental is 4 hours; trailers have a 24-hour minimum and no 4-hour rate. A rental longer than 4 hours is charged at the day rate, and longer rentals move to the week and 4-week rates. We apply the lowest rate tier that fits your rental time.
3.4 Extensions and late returns. Call (303) 423-7448 before your return time to extend. Extra time, whether arranged or not, is charged at the applicable rate. We allow a 30-minute grace period: equipment checked in no more than 30 minutes after the end of a rate period is charged for that period. There is no separate late penalty.
3.5 Equipment not returned. If equipment is not returned or arranged for within 72 hours after the agreed return time, we may treat it as unreturned, recover it, and report it to law enforcement. Under Colorado law (C.R.S. 18-4-401(1)(e)), knowingly keeping rented property more than 72 hours after the agreed return time can be theft.
3.6 Damage waiver. The damage waiver (Section 5) is 13% of the rental charges.
3.7 Sales tax. Colorado and local sales tax applies to rental charges, the damage waiver and items sold. Delivery charges are not taxed.
3.8 Other charges. Delivery trips, diesel fuel, cleaning, consumables and loss or damage are charged as described in this agreement and on the pages listed in Section 1.
4. Payment, card on file and later charges
4.1 Card on file. Unless your rental is billed to an approved business account, or we agree that you pay when it comes back (Section 4.12), you give us a credit or debit card (your “card on file”). Our payment processor, Stripe, stores your card details; we never see or store your full card number. By accepting this agreement, you authorize us to save the card and to charge it as described in this section.
4.2 Authorization when you reserve online. When you reserve online, we place a temporary authorization on your card for the estimated total, including tax and the damage waiver. An authorization is not a charge, though your bank may show it as pending. If you cancel before the rental starts, we release it. Banks usually keep an authorization for about 7 days, so on a reservation made further ahead it may lapse before the rental starts. That does not cancel your reservation. We will place a new authorization, or charge your card when the rental goes out. When you reserve by phone or at our counter for a later date, we save your card without an authorization, when you book or before the rental goes out, and charge it when the rental goes out.
4.3 Charge when the rental goes out. We charge your card when the equipment leaves our yard: at pickup, or when we deliver it. At our counter, that means you pay before the equipment goes out, normally on our card reader, and the card you use becomes your card on file. We charge what is actually due at that point. That may be less than the authorization, for example if you take fewer items or less propane, and we release the part we don’t use. If it is more, for example because you added items or days, we charge the difference separately. Your bank decides how quickly a released authorization disappears from your statement.
4.4 Later charges to your card on file. You authorize us to charge your card on file, without presenting it again, for these amounts when they become due under this agreement after the rental goes out:
- (a) Extra time. Extensions you ask for and late returns, at the applicable rate for the extra time. There is no separate late penalty.
- (b) Diesel fuel. Fuel to refill diesel equipment that comes back with less fuel than it left with: tow-behind air compressors, Toro Dingos, skid steers and mini excavators. Gasoline equipment carries no fuel charge.
- (c) Cleaning. Up to $200 when equipment comes back needing cleaning beyond normal use. We talk it through with you at return.
- (d) Loss or damage. What you owe after the damage waiver. Where the waiver does not apply (Section 5.3 lists the exclusions, such as theft, misuse, tires and tracks, consumables and damage in transit) or where you declined it, the full cost of repair or replacement.
- (e) Delivery trips. Delivery and pickup trips, including a trip we make that can’t be completed (a failed delivery).
- (f) Add-ons. Items you add at pickup or during the rental, such as propane or parts.
- (g) Taxes and balances. Tax on any of these, and any other amount still unpaid on the rental.
4.5 Notice and receipts. Before we charge for damage or cleaning, we tell you what we found and how much it is, with photos when we have them, and give you 2 business days to respond. Every charge gets an itemized receipt, emailed to the address on your order.
4.6 Business accounts. If you rent on an approved business account, we bill the rental on your monthly statement instead of charging a card. We charge a card on file, if you have one with us, only if you ask us to, or if a statement is more than 30 days past due.
4.7 Declined charges. If a charge is declined, we will contact you. You agree to give us another payment method and to pay what is due within 7 days. We may decline new reservations until the balance is paid.
4.8 How long this authorization lasts. This authorization covers this rental and lasts until everything owed on it is paid. We charge a saved card for a future rental only if you choose that card when you make the reservation. You can update or remove a saved card in My Account or by calling the counter. Removing a card does not cancel amounts you already owe, and while a rental is open we need another card on file before we remove it.
4.9 Questions and disputes. If you think a charge is wrong, contact us first at [email protected] or (303) 423-7448 and we will review it. This does not limit any rights you have with your card issuer.
4.10 Past-due amounts. Amounts not paid when due bear interest at 1.5% per month (18% per year) or the maximum rate Colorado law allows, whichever is less. You agree to pay our reasonable attorneys’ fees, court costs and collection costs incurred in collecting a past-due amount or enforcing this agreement.
4.11 Changes. If we change this section, the change applies only to reservations made after it.
4.12 Paying when the rental comes back. For any rental, we may agree that you pay when it comes back. If we do, nothing is charged or authorized when the rental goes out, we do not save a card for it, and Sections 4.1 to 4.3 do not apply to that rental. When it comes back, you pay everything owed on it in one payment, including the charges listed in Section 4.4. If you cannot pay then, we still check the equipment in, and the balance stays due on your order. You agree to pay it within 7 days.
5. Damage waiver
5.1 What it is. The damage waiver is 13% of the rental charges on your order, shown as one line and taxed with the rental. It is optional. It is added to every rental unless you decline it. To decline it, before the equipment goes out you must give us a copy of your insurance policy or a certificate of insurance that (a) covers rented equipment for its full value, such as an equipment floater or a commercial policy with rented-equipment coverage, and (b) lists Crowder Rentals LLC as loss payee for the equipment you rent. If you reserved online, we remove the waiver before we charge your card. Approved business accounts may instead keep a certificate of insurance on file that meets both conditions.
5.2 What it covers. With the waiver, you are not charged for accidental damage to the equipment during proper use, or for normal wear and tear.
5.3 What it does not cover. You remain responsible for:
- theft, loss, or equipment that is not returned;
- damage from misuse, overloading, operating outside the manufacturer’s instructions, or use by an unauthorized operator;
- damage from operating without proper fluids or with a known malfunction, or from running equipment that was smoking, leaking or overheating;
- tires, tubes and tracks damaged by curbing, punctures or running flat, and trailer damage from overloading, jackknifing or backing into objects;
- cutting teeth, blades, bits, hoses, cords and other consumables;
- damage while the equipment is in transit on your vehicle or trailer;
- vandalism, or damage from leaving equipment unsecured.
5.4 It is not insurance. The damage waiver is not an insurance policy. It provides no coverage for injury to any person or for damage to your property or anyone else’s.
5.5 If you decline it. If you decline the waiver, you are responsible for the full cost of repair or replacement of damaged equipment.
6. Condition, use and care of the equipment
6.1 Inspection. Equipment leaves fueled, serviced and inspected. Look it over before you use it and tell us at once about any damage or defect. Using the equipment confirms you received it in good working order, apart from anything you report.
6.2 Proper use. Use the equipment only for its intended purpose, within its rated capacity, and according to the manufacturer’s instructions, decals and safety devices. Use it in compliance with all laws, permits and jobsite rules. Call 811 for utility locates before you dig.
6.3 Things you may not do. Do not:
- operate the equipment while impaired;
- sublet it;
- remove safety devices;
- take it outside Colorado without our written permission.
6.4 Security. Keep the equipment secure when it is not in use.
6.5 Transport and towing. You are responsible for loading, securing, transporting and towing safely and within your vehicle’s ratings. For trailers, check the lights, coupler, chains and tire pressure during the rental.
6.6 Breakdowns. If equipment malfunctions, stop using it and call us. Do not attempt repairs. We will repair it, replace it with comparable equipment, or credit rental time for a confirmed mechanical failure that was not caused by misuse. That is our only obligation for a breakdown.
7. Fuel, cleaning and consumables
7.1 Diesel. Diesel equipment goes out full and should come back full: tow-behind air compressors, Toro Dingos, skid steers and mini excavators. We charge for the diesel needed to refill it.
7.2 Gasoline. Gasoline-powered equipment carries no fuel charge. We refuel it between rentals.
7.3 Cleaning. Normal jobsite dirt is expected and free. If equipment comes back with caked mud, cured concrete, paint or debris that takes real work to clean, a cleaning fee of up to $200 applies. We discuss it with you at return or, if our driver collected the equipment, tell you what we found before we charge (Section 4.5).
7.4 Consumables. Blades, bits, teeth, sandpaper, grinding discs and cleaning solution are sold separately, or rented where noted. They are charged for excessive wear or breakage.
8. Delivery and pickup
8.1 Charges. Delivery is available on orders that include a machine: a rental of $200 or more per day, or one of the attachments we deliver on their own. Each trip between our yard and your site is $50 plus $3.50 per mile, by driving distance, for each machine on the order. Other items on the same order ride along at no extra charge. Drop-off and pickup are separate trips, and you can choose either or both. This rate applies to sites up to 40 miles away; farther sites, and foothill and mountain addresses, are quoted. Trailers are not delivered; they are picked up and returned at our yard.
8.2 On site. Someone 18 or older must be on site to accept the equipment. Tell us about access limits, gates, slopes, soft ground and overhead lines. Our driver may decline to place equipment where it is unsafe.
8.3 Failed trips. If no one is on site, or the equipment cannot be placed or collected because of conditions we were not told about, the extra trip is charged at the same rate.
8.4 End of the rental. At the end of the rental, have the equipment shut down, accessible and reasonably clean at the agreed pickup time. You remain responsible for it until our driver collects it.
9. Returns
9.1 Hours. Return equipment to our yard during business hours, Monday–Saturday 7:00 AM–5:00 PM, and check in with staff.
9.2 Inspection closes the rental. A rental is not closed until we have inspected the equipment.
9.3 After hours. Equipment left after hours without our prior arrangement remains your responsibility until we check it in.
10. Your responsibility for loss and damage
10.1 When you are responsible. You are responsible for the equipment from the time it leaves our control until we check it in or collect it.
10.2 Theft or loss. Report theft or loss to us and to the police immediately, and give us a copy of the police report.
10.3 What you owe. Subject to the damage waiver, you owe the full cost of repair. If the equipment is lost, stolen, not returned, or not economically repairable, you owe its replacement cost.
11. Risk, warranties and limits on our liability
11.1 Assumption of risk. Rental equipment is inherently dangerous machinery. Operating construction, earthmoving, cutting, demolition, lifting, towing and powered lawn equipment involves risk of serious bodily injury, death and property damage. You assume those risks for yourself and everyone you allow to use the equipment.
11.2 No warranties. YOU ACCEPT THE EQUIPMENT “AS IS.” TO THE FULLEST EXTENT COLORADO LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Advice from our staff or our website is general information, not engineering or safety advice.
11.3 No indirect damages. WHETHER A CLAIM IS IN CONTRACT, TORT (INCLUDING OUR NEGLIGENCE), WARRANTY OR OTHERWISE, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOSS OF USE, DOWNTIME, JOB DELAY OR THE COST OF SUBSTITUTE EQUIPMENT.
11.4 Cap. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE RENTAL, WHETHER IN CONTRACT, TORT (INCLUDING OUR NEGLIGENCE), WARRANTY OR OTHERWISE, IS LIMITED TO THE AMOUNT YOU PAID US FOR THAT RENTAL.
11.5 What these limits do not cover. Nothing in this agreement limits liability for our willful and wanton conduct, or any liability that cannot be limited under Colorado law.
12. Indemnity
You agree to defend, indemnify and hold harmless Crowder Rentals LLC and its members, managers, employees and agents from claims, losses, damages, fines and costs (including reasonable attorneys’ fees) arising from:
- the possession, transport, towing, operation, storage or return of the equipment during the rental;
- any bodily injury, death or property damage caused by the equipment while in your possession or control;
- use of the equipment by anyone you allow to use it;
- your breach of this agreement or of any law or permit.
This does not apply to the extent a claim is caused by our own negligence or willful and wanton conduct. It survives the end of the rental.
13. Cancellation and changes
13.1 Your cancellations. To change or cancel a reservation, call (303) 423-7448. There is no cancellation fee and no charge for a missed pickup. When you cancel, we release any authorization.
13.2 Our cancellations. We may cancel a reservation, for example because equipment is damaged, breaks down or is returned late by another customer. If we do, we supply comparable equipment or refund anything you paid. That refund is our only obligation for an unavailable unit.
14. Electronic signature, records and notices
14.1 Signing. You may accept this agreement by signing at checkout on our website, by signing on the screen at our counter, or by signing a printed copy at our counter. For an order placed by phone, you accept it when you sign at pickup or delivery. Taking or using the equipment also confirms your acceptance. Your electronic signature has the same effect as a handwritten one under the Colorado Uniform Electronic Transactions Act (C.R.S. 24-71.3).
14.2 Records and notices. We keep a record of your acceptance with your order. We send receipts and notices to the email address on your order. You can reach us at 11401 W 44th Ave #1, Wheat Ridge, CO 80033, (303) 423-7448 or [email protected].
14.3 Calls and emails only. We contact you by phone and email; we do not send text messages.
15. Colorado law, venue and time to bring a claim
15.1 Colorado law. This agreement is governed by the laws of the State of Colorado, without regard to conflict-of-law rules.
15.2 Venue. Any lawsuit about this agreement or a rental must be brought in the state courts in Jefferson County, Colorado. If a federal court has jurisdiction, it must be brought in the United States District Court for the District of Colorado. Each party consents to personal jurisdiction there. Either party may instead bring a claim within small-claims limits in the Colorado small claims court where the law allows it to be filed.
15.3 Jury and class waiver. TO THE FULLEST EXTENT THE LAW ALLOWS, EACH PARTY WAIVES ANY RIGHT TO A JURY TRIAL, AND CLAIMS MAY BE BROUGHT ONLY INDIVIDUALLY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.
15.4 Time to bring a claim. Claims for breach of this agreement, or about goods sold under it, must be brought within the three-year period set by Colorado law (C.R.S. 4-2.5-506 and 4-2-725). Any other claim arising from a rental must be brought within one (1) year after it arose, to the extent Colorado law allows a shorter period.
16. General
16.1 Assignment. You may not assign this agreement or sublet the equipment. We may assign this agreement.
16.2 Severability. If any part of this agreement is unenforceable, it is limited to the extent necessary and the rest stays in effect.
16.3 No waiver. Our failure to enforce a term is not a waiver of it.
16.4 Survival. Every part of this agreement that by its nature applies after the rental ends — including charges, payment, loss and damage, the limits on our liability, indemnity, and Section 15 — survives the end of the rental.
16.5 Updates. We may update this agreement for future rentals. The version you accepted applies to your rental.
